Rules and Regulations of the Fallstone Homeowners Association
Here is a summary of some of the more pertinent rules and
regulations that you may have to deal with directly. In many cases, any changes
to existing appearances will require approval of the Architectural Control
Committee. Additionally, the Bylaws have been posted to the website and

1. Plants, Trees, Decks and Rear Yards.
Supplementing pertinent provisions in the Fallstone Homeowners Association’s
Declaration and By-Laws, a deck is not deemed part of the rear yard of a lot;
and, therefore, vegetable gardens are permitted within the rear yard, but not
permitted on a deck as long as the height of any such shrub, plant or tree does
not exceed three feet above the standard railing height, when fully mature.
Outdoor planters, whether on the deck or within the rear yard may not be more
than three (3) feet in diameter, or 3 feet by 3 feet if they are a square or
rectangle. Planters shall conform to the general architectural style of the
community. Fruit trees are not permitted under any circumstances within the rear
yard or on the deck; nor are willow trees, bamboo, or any similar plant with a
long root structure. The term “structure” as used in the Declaration and by-laws
shall include any item place on a deck of a permanent or semi-permanent nature
or that exceeds the sizes described above. The term “landscaping” shall include
any botanical item.
2. Privacy Fences
Privacy fences, including those placed on the existing railing of any deck,
require the approval of the ACC, but, in any event, may not exceed 3 feet in
height above the standard railing height; and must be of the lattice type
similar to those found in the community.
3. Paint Colors
The existing color schemes on the residences, including siding, wood, shutters,
doors, etc. shall be the only colors allowed. Any change to existing colors
require approval of the Architectural Control Committee. See the

4. Notice of Rules and Policies
Notice of any rules and policies of the ACC or the Board of Directors shall
constitute due notice to the entire community when passed and announced at a
general meeting of the Board of Directors open to all members of the Fallstone
Homeowners Association. In addition, the Board shall have such rules and
policies published in the Fallstone Newsletter, which will set forth full and
complete copies of any new rules and policies. Finally, all rules and policies
passed by the Board or the ACC shall be placed on the Community Bulleting Board
in Robin Park for a period of at least 2 weeks after adoption.
5. Board of Directors; Term of Office.
The Board consists of five members, each of whom serve for three years upon
election. Elections are held once a year and the rotation is 2 – 2- 1. Vacancies
can be filled by the Board.
6. Parking Rules
As you know, we have limited on-street parking and it is the Board’s policy that
it be reserved primarily for guest parking and we ask residents to park their
vehicles in their garages or driveways or specific assigned areas. There is no
parking where there are signs so indicating or where the curb is painted yellow.
For more specific rules, please refer to the Rules and Regulations document in
your possession or call one of the board members. Please note that there are
also rules regarding the kind of vehicles that may be parked in our community.
a. No vehicle shall be parked in such a manner as to impede or prevent ready
access to any homeowner’s driveway or on-street parking space, or to impede the
flow of traffic.
b. All motor vehicles operating or parked on Fallstone property shall display
valid motor vehicle license tags and be maintained in proper operating condition
so as not to be a hazard or nuisance by noise, exhaust emissions or appearance.
c. Other than routine maintenance, such as car washing and/or waxing, no
mechanical repairs shall be made on public space.
d. There shall be no commuter or long-term parking in any common area, which is
private property. Any vehicle without a permit in the same common area space
left unmoved for more than 5 days shall be considered a “stored vehicle,”
subject to removal at the owner’s expense.
e. The unauthorized posting of signs or any alterations to current on-street
parking designations is not allowed, without specific approval of the Board.
f. All parking complaints shall be first directed to Quantum to be handled
discreetly.
7. Satellite Dishes
a. This section governs the use and installation of direct broadcast satellite
services, antennas designed to receive video programming services, antennas
designed to receive television broadcast signals, masts designed to support such
antennas or any other device covered by the rules promulgated by the FCC and the
Over-theAir-Reception Devices Rule and Order (OTARD) within the Fallstone
Homeowners Association Community.
b. Satellite dishes larger than one meter in size are not permitted in the
Fallstone Homeowners Association (FHA) community.
c. The FHA’s preferred location for broadcast television antennas is the attic
of individual homes; however, this rule will be waived on a case by case basis
where an adequate reception is not possible in such a location or where
maintenance is not possible in such a location.
d. FHA’s preferred location for a qualifying satellite dish or qualifying
multichannel multipoint distribution reception device or any masts to support
such devices, is on the property owner’s rear lot where it is not visible from
the street, or on the rear roof, provided the satellite does not protrude above
the top of the roofline; however, this rule will be waived on a case by case
basis where adequate reception is not possible in such a location or where
maintenance is not possible in such a location.
e. Any mast taller than 12 feet in height must conform to the BOCA code and
requires prior review by the FHA Architectural Control Committee to ensure
installation conforms to applicable national safety standards.
f. No satellite dish, antenna, mast or reception device of any kind shall be
installed by a homeowner on common property nor cross the property boundaries of
the lot owned by the homeowner installing the device.
g. Devices covered by the OTARD Rule and Order and meeting these requirements do
not require prior approval from the Architectural Control Committee. Any device
not covered by the OTARD Rule and Order is not permitted under the Declaration
of Covenants, Conditions and Restrictions and shall be subject to the covenant’s
due process procedures for enforcement.
h. Should the OTARD Rule and Order be rescinded or declared illegal by a
competent court having proper jurisdiction, the FHA shall support and enforce
the Declaration of Covenants, Conditions and Restrictions’ prohibition against
such devices.
i. All inquiries or requests for approval shall be made to the Board of
Directors or the Architectural Control Committee, as the case may be, in
accordance with the rules and by-laws of the Fallstone Homeowners Association.
8. Trash Collections
Trash for collection must be placed in closed metal or heavy plastic cans.
Trashcans should be placed at the curb the morning of the scheduled collection
or the evening before (after dark). This rule applies to trash cans as well as
the bins used for newspapers, bottles, etc.
9. Playground in Robin Park
The use of Robin Park including the playground is restricted to residents and
their guests during reasonable daylight hours, i.e., between 10:00 a.m. and 7:00
p.m. or sunset. Children must be under adult supervision. Noise levels in Robin
Park shall be kept at reasonable levels so as not to disturb the neighbors.
